UPDATED: Magistrate Nadine Lia abstains from hearing compilation of evidence against Yorgen Fenech
The compilation of evidence against Yorgan Fenech which was supposed to start this morning in front of Magistrate Nadine Lia, whose name was drawn by lot on Monday, has been postponed.
Despite the fact that all parties were present outside of court room number 25, the court room remained closed. The lawyers concerned said that they had just been informed that the sitting would not be held. They also said that they were told that nothing had been confirmed that the compilation of evidence in this case would start today.
Both the lawyers representing Daphne Caruana Galizia’s family as well as Mr Fenech’s lawyers had submitted separate requests asking for Magistrate Lia to recuse herself because she is the daughter-in-law of the PM’s lawyer, Pawlu Lia and they therefore alleged a conflict of interest. The decision on these requests is expected to be given later today.
Magistrate Lia has abstained from hearing the case and it will now be assigned to another Magistrate.
