Prison sentenced changed to Probation after woman withdraws rape allegation

Omar Pisani, aged 35, had his prison sentence changed to Probation by the Appeals Court after the woman who had accused him of raping her withdrew her accusation and declared in Court the man had not held her against her will.

The case in Xgħajra goes back to April 2012, with Pisani being charged with having raped the woman in his car after she had filed a report four days after the incident. In 2015 Pisani was sentenced to prison for three years and five months for the rape.

The Appeals Court closely studied the witness reports and concluded the woman had not been held against her will and although she had to the opportunity to leave the car, she did not do so. However, the Court found the man had breached public decency and placed him under probation for three years.
