A prison inmate who is serving a life sentence, and who has had another seven years added to his sentence after he gravely injured another inmate, will see his case about this incident re-opened and heard afresh.
The case goes back to when David Norbert Schembri assaulted another prisoner at Corradino Correctional Facility and slashed at his eyes with a blade tied to a cigarette lighter with tape. Schembri had insisted he acted in self-defence.
In appealing the sentence, Schembri’s lawyers insisted that the Court of Magistrates had wrongly applied an article in the law which refers to the sentencing of a person already serving a prison sentence.
Madam Justice Consuelo Scerri Herrera acknowledged this error and sent back the case to the Magistrates’ Court.
